B-BBEE QSE sworn affidavit
Once turnover passes R10 million the exempted micro enterprise affidavit no longer applies, and most owners assume a rating agency is next. Not if the business is at least 51% black owned: the Codes say a qualifying small enterprise at that ownership proves its level by a sworn affidavit, Level 2 at 51% and Level 1 at 100%, and any certificate a verification agency issues for it is invalid. We check the ownership and the sector code, complete the dtic affidavit correctly and get it commissioned.
Independent paperwork service. ProperSA is an independent private company, not the dtic or the B-BBEE Commission. The affidavit template is free on the dtic website and you can complete it yourself. Our fee pays for the ownership and turnover check against the Codes, the right template for your sector, the affidavit completed without the errors that get them rejected at tender, and the commissioning arranged.
What the Codes say
- Statement 000, paragraph 5.1: a measured entity with annual total revenue between R10 million and R50 million is a qualifying small enterprise.
- Paragraph 5.3: a qualifying small enterprise that is 100% black owned qualifies for Level 1; at least 51% black owned, Level 2; and such an enterprise is only required to obtain a sworn affidavit annually confirming its turnover band and its level of black ownership.
- Below 51% black owned: the affidavit route does not exist; the enterprise is measured on the QSE scorecard by a SANAS accredited verification agency.
- The Commission’s 2018 notice: affidavits from 51% and 100% black owned qualifying small enterprises must be accepted, and any B-BBEE certificate issued to such an enterprise is invalid. Misrepresenting ownership or turnover is a criminal offence under the Act.
- Sector codes override. Construction, tourism, ICT, property and agriculture have their own codes and thresholds, so the sector decides which template and which turnover band apply.
What is included
- Ownership check: the black ownership percentage traced through the shareholding, including women, youth, disabled, unemployed, rural and military veteran breakdowns the template asks for
- Turnover check against the latest financial year end, and the sector code check that decides which template applies
- The dtic affidavit completed in full, for the general or sector specific form, with the Level 1 or Level 2 box correctly ticked
- Commissioning instructions: who may commission (not an employee of the enterprise), the dates that must match, and the twelve month validity from the commissioner’s date
- A tender file note explaining to a procurement officer why the affidavit replaces a certificate, with the Commission notice reference
- A diary reminder eleven months out, because the affidavit must be renewed every year

Frequently asked questions
Who qualifies for the QSE affidavit?
A business with annual total revenue between R10 million and R50 million that is at least 51% black owned. At 51% to 99% it is Level 2; at 100% it is Level 1. Below 51% black owned, a SANAS accredited agency must verify the business on the QSE scorecard.
Is the QSE affidavit free?
The template is free from the dtic and commissioning at a police station is free. ProperSA charges R390 to check the ownership and sector, complete the affidavit correctly and arrange the commissioning, because an affidavit with the wrong template, band or date is rejected at tender.
How long is the affidavit valid?
Twelve months from the date the commissioner of oaths signs it. It must be renewed every year on the latest financial year end figures.
Can my accountant commission it?
A commissioner of oaths who is not an employee of the business, and ideally has no interest in it. A police station, a practising attorney or a commissioner at a bank or post office is the usual route.
What if my turnover is under R10 million?
Then you are an exempted micro enterprise and use the EME affidavit instead, which is the B-BBEE affidavit service at R490 with the tender pack.
Usually ordered with it
- B-BBEE affidavit and tender pack, R490. The exempted micro enterprise version, under R10 million.
- Tender ready pack, R890. CSD, tax compliance and the rest of the tender file.
- CSD registration, R490. Where the affidavit is uploaded for state tenders.
- Letter of good standing, R690. The other document every tender asks for.
